Welcome to www.lancerscape.com, owned and operated by Lancerscape Global Private Limited (hereinafter referred to as “Lancerscape” or “the Platform”). By accessing or using our website, you agree to these terms and conditions. If you do not agree with any of these terms, please refrain from using our services. We reserve the right to modify these terms at any time, and your continued use of the Platform constitutes acceptance of any changes.

1. Introduction and Scope

Lancerscape is an online platform that connects freelancers with sponsors seeking various services. By using our Platform, you agree to be bound by these terms and conditions, as well as any other guidelines, policies, or rules posted on the Platform.

2. Eligibility to Use Our Site

Use of the Platform is limited to individuals who can form legally binding contracts under applicable law. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872, including minors, un-discharged insolvents, and others deemed incapable of contracting, are not eligible to use the Platform. If we discover that you are under 18 years of age or otherwise legally ineligible, we reserve the right to terminate your access to the Platform immediately.

3. Membership and Account Security

While you may browse the Platform as a guest, registration is required to access certain features. By registering, you agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain the security of your account by safeguarding your password.
  • Notify us immediately of any unauthorized use of your account.
  • Be responsible for all activities that occur under your account.

Lancerscape reserves the right to suspend or terminate accounts at its discretion, particularly if any information provided is found to be false or misleading.

4. Freelancer and Sponsor Responsibilities

Freelancers and sponsors using the Platform agree to enter into a separate service agreement upon engagement. Lancerscape is not a party to this agreement and will not be held liable for any breach of contract by either party.

Both freelancers and sponsors are responsible for complying with all applicable laws and regulations in the course of their transactions. This includes, but is not limited to, tax obligations, labor laws, and intellectual property rights.

5. Payments and Fees

All payments between sponsors and freelancers are processed through the Platform's payment gateway. The Platform may charge a service fee, which will be clearly disclosed prior to any transaction. Freelancers are paid upon the satisfactory completion of the agreed-upon services, subject to the sponsor's approval.

Refunds and Disputes: Refunds are handled on a case-by-case basis, and any payment disputes must be reported within 10 days of the transaction. The Platform will attempt to mediate disputes but is not responsible for enforcing any agreements between freelancers and sponsors.

6. Intellectual Property Rights

Freelancers retain all intellectual property rights to the work they create until full payment is received from the sponsor. Upon payment, all rights are transferred to the sponsor, unless otherwise agreed in writing.

All content, trademarks, and logos on the Platform are the property of Lancerscape or its licensors and may not be used without permission.

7. User Conduct

Users are expected to conduct themselves professionally and respectfully. Prohibited activities include, but are not limited to:

  • Misrepresentation of skills or qualifications.
  • Spamming, soliciting, or harassing other users.
  • Posting false, misleading, or defamatory content.
  • Engaging in any activities that would constitute a breach of contract or violation of applicable laws.

Lancerscape reserves the right to remove any content or suspend any account that violates these terms.

8. Termination of Accounts

Lancerscape may terminate or suspend your account at any time, with or without notice, for conduct that we believe violates these terms, is harmful to other users, or is otherwise inappropriate. Upon termination, you will no longer be able to access your account, and any pending transactions may be canceled at our discretion.

9. Liability Disclaimer

Lancerscape provides the Platform on an "as is" and "as available" basis. We do not guarantee that the Platform will meet your requirements, be uninterrupted, secure, or error-free. Lancerscape disclaims all liability for any damages arising from the use of the Platform, including but not limited to direct, indirect, incidental, and consequential damages.

You agree to indemnify and hold harmless Lancerscape, its officers, directors, employees, and affiliates from any claims, losses, or damages arising from your use of the Platform, including any breach of these terms.

10. Privacy and Data Protection

Your privacy is important to us. We collect, use, and disclose personal information in accordance with our Privacy Policy, which is incorporated into these terms by reference. We comply with applicable data protection laws, including GDPR and CCPA, and take reasonable measures to protect your personal information.

We may share your data with third-party service providers as necessary to operate the Platform, such as payment processors and cloud service providers. By using the Platform, you consent to such sharing.

11. Dispute Resolution

In the event of a dispute between a freelancer and a sponsor, both parties are required to first attempt to resolve the issue using the Platform's dispute resolution process. Should the dispute remain unresolved after this initial attempt, either party may then choose to escalate the matter by initiating the mediation or arbitration process available through our platform. The outcome of the mediation/arbitration will be considered final and binding on both parties, subject to the Platform's rules and applicable laws.

Lancerscape's role in disputes is limited to providing a forum for resolution and does not involve any legal enforcement of the outcome.

12. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of India. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in Chennai,Tamilnadu,India.

13. Changes to Terms and Conditions

We reserve the right to update these terms and conditions at any time. Significant changes will be communicated to users via email or through a prominent notice on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the new terms.

14. Miscellaneous

Force Majeure: Lancerscape will not be liable for any failure to perform due to causes beyond our reasonable control, including but not limited to natural disasters, war, or acts of government.

Severability: If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement: These terms, along with our Privacy Policy, constitute the entire agreement between you and Lancerscape regarding the use of the Platform.
